There were a lot of things that didn't sound right but one of the questions I came out with has to do with the insistence from both lawyers, city's and PMUA's, that "PMUA was not an agency and instrumentality of the city."
However, the lawyers insistence just didn't register with me. So, I searched the DUMPPMUA website to see if they would have something that could answer the "agency and instrumentality" question. Here is what I found on THIS DOCUMENT, among many more at the DUMPPMUA site (just scroll down and you will find them):
Page 2, 1995 City Council Ordinance, Section IISo, PMUA is clearly an agency and instrumentality of the city. It is on black and white. If anything changed after PMUA was created in 1995 then that should be clarified and documentation should be provided but until it is proven that there was a change we should consider PMUA "an agency and instrumentality of the city".
The Plainfield Municipal Utilities Authority is and shall be an agency and instrumentality of the city created by ordinance duly adopted by the city council,
Why both lawyers, city and PMUA, insisted that the contrary was truth is just beyond my understanding of PMUA matters but hopefully the council will set this matter straight and correct any misconception that there is on what exactly PMUA is to the city. Once we all know what the documented facts are it is pretty difficult to "unlearn" the truth.
